General Terms and Conditions for GPSR Templates

1. General
1.1 These General Terms and Conditions apply to all agreements and deliveries from GPSR Templates, located at Marsstraat 17, 2024GA Haarlem, registered with the Chamber of Commerce under number 95234780, regarding the sale and delivery of online templates via our website www.gpsr-templates.com.
1.2 By placing an order on our website, the buyer agrees to these General Terms and Conditions.
2. Services
2.1 GPSR Templates offers online templates that provide guidance to help the buyer comply with the General Product Safety Regulation (GPSR).
2.2 The templates are solely designed as tools and provide a basis that the buyer can adjust and/or use according to their specific situation, at their own discretion and responsibility.
2.3 GPSR Templates does not guarantee that using the templates will automatically make the buyer fully compliant with the GPSR or any other laws or regulations.
3. Prices and Payments
3.1 All prices on the website are listed in euros and exclude VAT unless otherwise stated.
3.2 Payment must be made through the payment options provided on the website.
3.3 GPSR Templates reserves the right to change prices and offers without prior notice.
4. Delivery
4.1 After receiving payment, the purchased product is delivered directly in digital form via a download link or by email.
4.2 The buyer is responsible for downloading and saving the product.
5. Liability
5.1 All templates and products are provided "as is," without any express or implied warranty of compliance with applicable laws and regulations. GPSR Templates accepts no liability for any direct, indirect, incidental, or consequential damages resulting from the use of the templates. This includes, but is not limited to:
Errors, imperfections, or outdated information in the templates;
Non-compliance with laws or regulations, including the GPSR, through the use of the templates;
Decisions, actions, or omissions by the buyer arising from the use of the templates.
5.2 The buyer acknowledges that GPSR Templates is not a legal or professional service provider and that the templates are not a substitute for legal or professional advice. GPSR Templates does not provide legal advice in any form, and the templates should not be considered as such. It is the buyer's responsibility to seek professional advice if necessary and to review and adapt the templates to their own situation.
5.3 The templates are intended solely as a general tool for the buyer to possibly comply with the General Product Safety Regulation (GPSR) or other relevant regulations. GPSR Templates does not guarantee that the templates are suitable for a specific situation, complete, accurate, error-free, or up-to-date. GPSR Templates makes no guarantee that using the templates will result in compliance with any law or regulation.
5.4 Use of the templates is entirely at the buyer's own risk. The buyer acknowledges that they are fully responsible for the use, adaptation, and interpretation of the templates, and for achieving compliance with relevant laws and regulations. GPSR Templates is not liable for any decisions, actions, or omissions of the buyer based on the use of the templates, nor for the outcomes thereof.
5.5 GPSR Templates is not liable for any form of indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of revenue, loss of profit, loss of opportunities, loss of data, business interruption, or reputational damage, even if such damages arise from a situation where GPSR Templates has been informed of the possibility of such damages.
5.6 In the event that GPSR Templates, despite the above exclusions, is held liable, the total liability of GPSR Templates to the buyer, regardless of the legal basis, will never exceed the amount the buyer has actually paid for the templates that gave rise to the liability.
5.7 GPSR Templates is not liable for the unavailability of the website or the inability to download the templates, nor for technical problems or malfunctions of any kind.
5.8 The buyer indemnifies GPSR Templates against all third-party claims arising from the buyer’s use of the templates. Use of the templates by third parties is entirely at the risk and responsibility of the buyer.
6. Intellectual Property
6.1 All intellectual property rights related to the templates and other materials made available through the website remain the property of GPSR Templates.
6.2 The buyer is not permitted to copy, distribute, or otherwise commercially exploit the templates without prior written permission from GPSR Templates.
7. Right of Withdrawal
7.1 Since the products are digital and delivered immediately after purchase, the buyer expressly waives their right of withdrawal from the moment of delivery.
7.2 Refunds are not possible after receiving the digital products.
8. Changes to the General Terms and Conditions
8.1 GPSR Templates reserves the right to change these General Terms and Conditions at any time.
8.2 Any changes will take effect from the moment they are published on the website.
9. Complaints Procedure
9.1 GPSR Templates has an adequately publicized complaints procedure and handles complaints in accordance with this procedure.
10. Applicable Law
10.1 These General Terms and Conditions are governed exclusively by Dutch law.
